The information provided in relation to the Merchant Opportunities Fund to you, by the Responsible Entity or the Fund Manager, their affiliates, agents, representatives, employees, or any other associated entities, including but not limited to all information contained in the Product Disclosure Statement, email communications, and any other materials that relate to the Merchant Opportunities Fund, is intended solely for the use of the recipient and is strictly private and confidential (Confidential Information). The Confidential Information must not be disclosed to third parties without prior written consent from the Responsible Entity or Fund Manager, from time to time, of the Fund. The Responsible Entity and the Fund Manager reserves all rights to pursue legal action for any unauthorized use or disclosure of the Confidential Information.

You agree to indemnify the Responsible Entity and Fund Manager, from time to time, of the Fund against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or in connection with any unauthorized distribution or disclosure of the Confidential Information by you. This indemnity extends to any actions, causes of action, claims, or demands made by third parties as a result of such unauthorized distribution or disclosure of the Confidential Information.
